Our process for filing trademark applications is simple. Hayes Soloway offers clients a full service filing of trademarks at a flat fee of $1100 USD for one class, including filing fees charged by the United States Patent and Trademark Office ("USPTO"). Included within this flat fee is our review of the mark and the description of the mark, a determination of the type of use of the mark, if not provided, and a thorough review of the specimen provided to us, if any. When a specimen is not provided to us, we will search for an appropriate specimen on a client's website at no extra cost. We select the class or classes based on the description provided to us and often offer our clients strategic filing options when more than one class is available.

After registration of the mark, Hayes Soloway offers trademark service for all types of registration maintenance and renewals, most importantly, the preparation of the declaration of use (§8) and declaration of incontestability (§15), and renewals every ten years. We track all events of the trademark registration in our docketing system and send reminders for all events. We also offer clients a wide-range of other trademark services, including trademark watching and handling of oppositions, cancellations, and recordation of trademarks with US Customs.

In complement to our high-quality services, we strive to provide our clients with quick communication and convenient billing practices. Official Actions from the USPTO and other communications are reported to clients within two business days. Our aim is to expedite communication and prevent incurring rush or late fees, when at all possible. We also provide invoicing per matter on the vast majority of matters, allowing our clients to receive one final invoice with the total cost of the service, not successive invoices based on billing periods.

Hayes Soloway has extensive experience with enforcing trademark rights and defending against trademark suits. Trademark litigation is unique today in that the application of the law tends to vary slightly from circuit to circuit and even from case to case. This is because trademark adjudication requires the fact-finder to make some inherently subjective distinctions.
